Also enclosed are maps associated with an Affected Land Exchange for the <br /> Climax Mine. As discussed during your inspection on September 4, 1997, the Climax <br /> Molybdenum Company (CMC) intends to exchange affected land in the Searle Gulch area for <br /> land situated above the Mayflower Tailing Pond to install a surge line for the extension of the 5- <br /> Dam pumpback line. This extension was described in a letter to you on August 22, 1997. <br /> The following information is being provided per the Division's procedures for exchange of affected <br /> land: <br /> • CMC waives a 30 day decision by the Division for this Technical Revision. <br /> • A check in the amount of$850.00 is attached to cover fees for the exchange. <br /> • Public Notification has been initiated in Summit County with publications for four consecutive <br /> weeks, through October 24, in the Summit County Journal. All exchange lands are located <br /> within Summit County. Climax will provide proof of notification as required. <br /> • There are no access easements or private land holdings within 200 feet of the affected land <br /> exchange. No additional public notifications are therefore required. <br /> • The application has been posted for public review at the Summit County Clerk and <br /> Recorder's Office. Copies of the notification have been provided to the Summit County Board <br /> of County Commissioners and the Soil Conservation Service. Copies of these letters are <br /> attached. <br /> • Bonding for the exchanged land and the newly appropriated affected area can remain equal <br /> at $2,426.00 per acre. No change in the Climax Mine financial surety is foreseen by this <br /> exchange. The reclamation plan covered by Amendments AM-02 and AM-03 remain in place <br /> for all affected acreage. <br /> Pursuant to item No. 2 of the Division's land exchange procedures, please let me know at your <br /> earliest convenience when an inspection can be arranged. Thank you in advance for your review <br /> and acceptance of the surge line placement for the 5-Dam Pumpback Line extension and the ' <br /> Affected Land Exchange. <br />
