Dedication of Water Rights to the <br />Aggregate Industries Combined Substitute Supply Plan <br />Aggregate Industries — WCR, Inc. (Al), is the owner of 13.5 shares of the Whitney Ditch <br />Company (which are associated with the W.W. Farms Pit, DRMS Permit No. M -99 -098), and 96 <br />shares of the Fulton Irrigating Ditch Company (which are not associated with any specific site <br />but rather are associated generally with the entire Al Combined Substitute Water Supply Plan <br />(CoSSP)). Al hereby affirms that the above water rights will be dedicated solely to the Al CoSSP <br />for as long as there are depletions at the associated gravel pits or until such time as another <br />replacement source is obtained. The water rights will not be sold, leased, or traded to others <br />during the term of this dedication.
