The total area of pond surface exposed for each of the pits shall not exceed those values <br />listed in Table A of this approval. Should the total surface area exposed exceed those <br />amounts, an amendment will need to be filed with this office. The total amount of ground <br />water to be consumed at the gravel mining operations shall not exceed the values listed in <br />Table C of this approval. Should the amount of ground water to be appropriated from each <br />of the pits exceed the values listed in Table C, an amendment will need to be filed with this <br />office. <br />4. Dewatering at the pits will produce delayed depletions to the stream system. At least three <br />years prior to completion of mining, a plan must be submitted that specifies how the post <br />pumping dewatering depletions (including refilling of the pit) will be replaced in time, place <br />and amount. <br />5. Prior to claiming any credit for the water returned to the stream system from dewatering in <br />excess of lagged dewatering depletions (a net accretion), the applicant must install a <br />totalizing flow meter that accurately measures the quantity of water being pumped and <br />returned to the stream system via dewatering operations and account on a real time basis <br />for the actual dewatering depletions and accretions. No net accretion credits are sought by <br />the Applicant for this approval period. <br />6. The installation of any device used for measuring replacement water in this plan must be <br />inspected by a Division 1 hydrographer. Furthermore, the exact location of all return <br />structures utilized in this plan must be provided to the Division Engineer and Water <br />Commissioner in order to allow for inspections of the structures. Finally, all charts or other <br />output data associated with each measuring device utilized in this plan must be provided in <br />a timely manner acceptable to the Water Commissioner. <br />7. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the applicant shall maintain daily records <br />of all diversions, replacements, and the amount of water used for each particular purpose. <br />The applicant shall provide a report of these records to the division engineer and the water <br />commissioner on a monthly basis on a form approved by them. The accounting must be <br />submitted to the division engineer in Greeley (Div1Accountinq(a state.co.us) and the water <br />commissioners William Schneider (William.Schneiderstate.co.us), Mark Simpson <br />(Mark.Simpson @state.co.us), Shera Sumerford (Shera.Sumerford@state.co.us), and Bob <br />Carlson (Bob.Carlsonstate.co.us) within 30 calendar days of the end of the month for <br />which the accounting is being made. Submitted accounting shall conform to the <br />Administration Protocol `Augmentation Plan Accounting, Division One — South Platte River" <br />(attached) <br />In addition, the applicant shall verify that each entity making replacements for this plan, <br />have included this plan in their respective accounting submitted to the Division Engineer. <br />For this plan those entities are the City of Westminster, City of Thornton, City of Greeley, <br />and Centennial Water and Sanitation District. <br />8. All releases of replacement water must be sufficient to cover all out -of- priority depletions in <br />time, place, and amount and must be made under the direction and /or the approval of the <br />water commissioner(s). The release of replacement water may be aggregated to maximize <br />beneficial use. The water commissioner(s) and /or the division engineer shall determine the <br />rate and timing of an aggregated release. <br />9. The approval of this substitute water supply plan does not relieve the Applicant and /or <br />landowner of the requirement to obtain a Water Court decree approving a permanent plan <br />
