Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RECEIVED <br />tN 0 0 ?013 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />We have reviewed your October 2, 2012 letter requesting the renewal of a substitute water <br />supply plan ( "SWSP ") for a limestone quarry operated by Holcim (US) Inc. ( "Holcim ") in accordance <br />with § 37 -90- 137(11), C.R.S. The most recent SWSP approval letter was dated June 4, 2012. <br />Updated engineering has been provided in support of this request. The $257 renewal fee has <br />been accepted with receipt no. 3657265. <br />Plan Operation <br />Holcim's Portland Plant manufactures Portland cement, which involves quarrying of raw <br />materials such as limestone and silica, grinding, pyro - processing, and storing and shipping <br />activities. The Portland Plant uses raw materials obtained from the Holcim Quarry, which <br />operates under the Division of Reclamation, Mining and Safety (DRMS) Permit No. M- 1977 -344 <br />and is the subject of this SWSP request. Depletions of groundwater within the mining boundary <br />consist of evaporation of the exposed groundwater pits, water pumped from the pits for dust <br />suppression, and water removed with the mined product, for which replacement water is <br />proposed to be supplied from a lease with the Board of Water Works of Pueblo and the <br />evaporation loss component of the changed Porter Ditch water right decreed in Case No. <br />92CW35. According to the submittal, you indicated that there are four ponds at the Holcim <br />Quarry as follows: Portland Quarry Pond (aka "Duck Pond ", Permit No. 44376 -F), the North <br />Pond, the East Pond and the Glory Hole Sump. Depletions of groundwater from the original <br />Portland Quarry Pond (aka "Duck Pond ") are being replaced by the water right decreed in Case <br />No. 92CW35, and is not part of this SWSP as the pit is located outside of the DRMS permitted <br />boundary. Although the decree in Case No. 92CW35 was approved to replace the evaporation <br />losses from the Duck Pond, the State Engineer's Office ( "SEO ") previously agreed that the Duck <br />Pond was developed in the early 1960's and 1970's as a result of the mining operation and <br />under Senate Bill 120 and § 37 -90- 137(11), C.R.S., this pond qualifies as a pre -1981 pit that <br />does not require replacement of depletions due to evaporation.
