Zalkind: <br /> Ron Zuck of the Climax mine has asked this office <br /> to contact you regarding your letter of February 9, 1982 . In <br /> that letter you stated that Climax ' s anniversary date was <br /> February 22nd, and that the annual fees for 1978-79 and <br /> 1979-80 were in arrears . <br /> We do not agree . <br /> Climax applied for a mining permit on September 29, <br /> 1977 pursuant to the requirements of C.R. S. 1973 § 34-32-109 (4) . <br /> The application was deemed complete on October 12, 1977 , and <br /> approved by the board on February 22, 1978. However, Climax ' s <br /> surety was not accepted until March 4, 1980, and the mining <br /> permit is dated March 6, 1980. The board approved an amendment <br /> to this permit on November 19, 1980 , and surety for the <br /> amendment was accepted on February 5, 1981 . <br /> Understandably, there has been considerable confusion <br /> over Climax ' s anniversary date . However, based on the foregoing <br /> facts , we conclude that Climax ' s anniversary date is March 4, <br /> and that the first annual fee was due on March 4, 1981 . We <br /> understand that this fee was paid on October 26, 1981 , and that <br /> the second annual fee was paid in a timely fashion, on March 2 , <br /> 1982 . Consequently, we conclude that Climax has complied with <br /> all requirements of C. R.
