Box 219 Director Nucla, CO 81424 Re: New Horizon Mine (Permit No. C- 1981 -008) Permit Revision Application No. 7 (PR -7) Revised Prime Farmland Determination and Related Soil Redistribution and Revegetation Plans Dear Sir or Madam: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on January 3, 2013, an application to revise coal mining operations at the New Horizon Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. With this application, the operator proposes to revise the acreage of prime farmlands identified within the permit area. This modification is based on a re- evaluation of available soil survey information and on new soils data gathered in 2011. The application materials include updated maps and sections of the permit which address baseline soils and vegetation; prime farmland investigation; and reclamation of both prime and non -prime farmlands. The Surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla, Colorado. The permit area is further described as follows: Sections 25 and 36, Township 47 North, Range 16 West, Section 31, Township 47 North, Range 15 West: Section 6, Township 46 North, Range 15 West; and Section 1, Township 46 North, Range 16 West. The above - mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla. A copy of the revision application is available for public inspection at the Montrose County Courthouse, 300 Main Street, Nucla, CO 81424, and at the Division office.
