December 24, 2012 <br />DeBeque Pit (M2011 -054) SWSP Page 3 <br />dewatering stops and based on the 2012 assumed call period on the Colorado River below Shoshone <br />Power Plant, you determined that there are no out -of- priority depletions during the first year of operation <br />and out of priority lagged depletions resulting from filling of the pit total 2.55 acre -feet in the second year if <br />the dewatering ceases (Table 4). Also, for the walk -away analysis you have assumed that the maximum <br />total mined area will be limited to 11.6 acres and based on the assumed call period on the Colorado <br />River below Shoshone Power Plant, out of priority lagged walk -away evaporative depletions total 22.03 <br />acre -feet (Table 5). The total out -of- priority depletions from pit filling and out of priority lagged walk -away <br />evaporative depletions are 24.58 acre -feet (Table 6). <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and <br />Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires <br />that you provide information to DRMS to demonstrate you can replace long term injurious <br />stream depletions that result from mining related exposure of ground water. <br />In accordance with approach nos. 1 and 3, you have indicated that a bond has been <br />obtained for $423,630.40 through the Division of Reclamation, Mining, and Safety ( "DRMS ") to <br />assure that depletions from groundwater evaporation do not occur in the unforeseen event, or <br />events, that would lead to the abandonment of the Pit or if dewatering ceases. <br />Replacement <br />United has entered into water supply contract with the Colorado River Water Conservation <br />District ( "CRWCD ") (Contract no. CW12006). Under this contract United is entitled to the delivery of <br />water. The contract with CRWCD is for 7.9 acre -feet annually. A copy of the contract was submitted <br />on December 17, 2012 and is attached to this letter. A 10 percent transit loss is assessed to the <br />replacement water. <br />The source of replacement water from CRWCD was identified as Wolford Mountain Reservoir. <br />Wolford Mountain Reservoir is located on the Muddy Creek drainage and it was decreed by the <br />Division 5 Water Court in case nos. 87CW283, 95CW281 and 98CW237. <br />Based on review of Colorado River call records below Shoshone Power Plant over the period of <br />record from 1987 to 2011, the Colorado River placed a call for 111 days during the months of April <br />through October 2002. However, to be conservative for the purpose of this SWSP you have assumed a <br />call period of 160 days for April (4 days), May (5 days) and from the last two weeks of June through the <br />first two weeks of November (as outlined on the attached Table 3). Therefore, based on the above, <br />out -of- priority lagged depletions during the first year of operations is 6.15 acre -feet and during the <br />second year of operation is 6.55 acre -feet. <br />Conditions of Approval <br />This SWSP is hereby approved pursuant to § 37 -90- 137(11), C.R.S., subject to the following <br />conditions: <br />1. This plan is approved with the effective date of August 1, 2012 and shall be valid through July 31, <br />2014 unless otherwise revoked or modified. If this plan will not be made absolute by a water court <br />action by the plan's expiration date, a renewal request must be submitted to this office with the <br />statutory fee of $257 no later than June 15, 2014. <br />
