Hickenlooper <br />Governor <br />Mike King <br />Executive Directoi <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />Dear Mr. Foster: <br />We have reviewed your April 11, 2012 letter and the additional information from June 26, 2012 <br />and December 17, 2012 requesting a substitute water supply plan ( "SWSP ") for the DeBeque Pit on <br />behalf of Oldcastle SW Group, Inc. (a.k.a. United) ( "United" or "Applicant "), in accordance with § 37 -90- <br />137(11), C.R.S. The required fee of $1,593 for the SWSP request has been submitted (receipt no. <br />3654903). <br />SWSP Operations <br />This SWSP seeks to replace depletions resulting from mining operations at the DeBeque <br />Gravel Pit (M2011 -054), which is located in Section 9, Township 9 South, Range 97 West of the 6th <br />P.M. in Mesa County. The proposed mining operation consists of three phases. During each phase, <br />water will be continuously pumped from a six foot wide dewatering trench surrounding the excavated <br />area into a dewatering sump. The approximate life span of the proposed gravel operation is eighteen <br />years. During this SWSP period United will conduct mining operations under Phase I (11.6 acres) of <br />the mining plan, which is anticipated to last approximately seven years. The depletions that result from <br />the mining operations are evaporation from exposed ground water, water lost in the mined product, <br />and water used for dust suppression. The mine is located in Mesa County in the SW1 /4 of Section 9, <br />Township 9 South, Range 97 West of the 6 P.M. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br />Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators <br />must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and <br />Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires <br />that you provide information to DRMS to demonstrate you can replace long term injurious <br />stream depletions that result from mining related exposure of ground water. <br />In accordance with approach nos. 1 and 3, you have indicated that a bond has been <br />obtained for $423,630.40 through the Division of Reclamation, Mining, and Safety ( "DRMS ") to <br />assure that depletions from groundwater evaporation do not occur in the unforeseen event, or <br />events, that would lead to the abandonment of the Pit. <br />Office of the State Engineer ,' OSj <br />1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 -866 -3581 • Fax: 303 - 866 -3589 <br />www.water.state.co.us <br />
