OBSERVATIONS <br />PERMIT #: M- 1977 -526 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: December 14, 2012 <br />The Division conducted a monitoring inspection of the site in a response to a written complaint from a citizen, Mrs. <br />Winifred Bromley, who resides at 12801 Brighton Blvd. Mrs. Bromley indicated that the basement of her rental property <br />and adjacent pasture land are now under water from the mining activities being conducted adjacent to her property. <br />Her property is surrounded by the Stagecoach pit MLRB # M- 1983 -067 to the south and west; by the Worthng Pit MLRB <br /># M- 1977- 526(Albert Frei & Sons) to the west and north and by Pit # 29 MLRB # M- 1980 -193 (Brannon Sand and Gravel) <br />to the east. She also stated that about two years ago Albert Frei & Sons started dewatering the Worthng Pit MLRB # M- <br />1977 -526 located north of the Bromley house. Once the dewatering started three of the Bromley's wells went dry. The <br />operator agreed to and paid for city water to replace these wells until dewatering ceased and backfilling commenced in <br />late 2012. Once the dewatering ceased and the operator started back filling the pit along the north side the wells <br />recharged. <br />Berhan Keffelew, Tom Kaldenbach and Tony Waldron of the Division met with Ben and Al Frei the operators and Steve <br />O'Brien their consultant. The inspection focused on the area being backfilled for the above pit. This area is due west of <br />the Bromley property. The Division noted a small pond that was in place in the area being backfilled at the time of the <br />inspection. The backfilling area and pond were walked and inspected to see if the water from the pond had an outlet to <br />the South Platt River. The Division did not observe any outlet for this water at the time of the inspection. After the <br />inspection the Division collected piezometer reading from the well placed within the Bromley property. Piezometer 008 <br />measured about 2.5 feet above the recorded high value for the well. The Division also wanted to see the flooded <br />basement but the owner could not find the key. However Mrs. Bromley had included a picture of the flooded basement <br />with her complaint letter. <br />After the inspection the Division recommended the operator cut a trench to dewater the small pond to the river using <br />their current dewatering discharge permit. The operator agreed to cut the trench as soon as possible. Once the pond is <br />dewatered, the Division and operator will monitor the progress of the mounding problem in the basement and pasture <br />land. If as expected the mounding problem is solved, the operator will submit an engineered design trench (under drain) <br />as a permanent solution to the problem through a revision process. <br />Page 2 of 4 <br />
