This SWSP shall be valid for the period of January 1, 2013 through December 31, 2013, <br />unless otherwise revoked, modified, or superseded by decree. If this SWSP will not be <br />made absolute by a water court action by the expiration date of the SWSP, a renewal <br />request must be submitted to this office with the statutory fee (currently $257) no later than <br />November 1, 2013 . <br />2. Well Permit No. 75680 -F has been obtained for the gravel pit in accordance with § 37 -90- <br />137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Derr Pit must not exceed 0.75 <br />acres during the approval period of this SWSP resulting in an annual evaporative loss of <br />2.19 acre -feet. <br />4. The annual total product mined at the Derr Pit shall not exceed 250,000 tons per year <br />resulting in 7.36 acre -feet of water lost with the mined aggregate and 2 acre -feet of water <br />lost due to dust suppression. <br />5. Total consumption at the Derr Pit must not exceed the aforementioned amounts unless <br />an amendment is made to this SWSP. <br />6. Approval of this SWSP is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by the State Engineer's Office. <br />7. The replacement water that is the subject of this SWSP cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this SWSP, the replacement <br />water must be appurtenant to this site until a plan for augmentation is obtained. All <br />replacement water must be concurrent with depletions in quantity, timing and locations. <br />8. The name, address and phone number of the contact person who will be responsible for <br />the operation and accounting of this SWSP must be provided with the accounting form <br />to the division engineer and water commissioner. <br />9. Adequate accounting of depletions and replacements must be provided to the division <br />engineer in Greeley (Div1Accountinq(state.co.us) and the water commissioner (Mark <br />Simpson at mark.simpsonstate.co.us) on a monthly basis. The accounting form <br />provided with your application is subject to modification and approval by the division <br />engineer. Submitted accounting shall conform to the Administration Protocol <br />"Augmentation Plan Accounting, Division One — South Platte Basin" (attached) <br />In addition, it is the applicant's responsibility to verify that the entities making replacements <br />are identifying this use on their accounting submitted to our office. For the period of this <br />plan, that entity is City of Greeley (WDID 0303330 - GLIC Accounting). <br />10. All water pumped for dust control purposes shall be measured in a manner acceptable <br />to the division engineer or water commissioner. <br />11. The approval of this SWSP does not relieve the Applicant and /or landowner of the <br />requirement to obtain a Water Court decree approving a permanent plan for <br />augmentation or mitigation to ensure the permanent replacement of all depletions, <br />including long -term evaporation losses and lagged depletions after gravel mining <br />operations have ceased. If reclamation of the mine site will produce a permanent water <br />surface exposing groundwater to evaporation, an application for a plan for <br />augmentation must be filed with the Division 1 Water Court at least three (3) years prior <br />to the completion of mining to include, but not be limited to, long -term evaporation <br />
