2 <br /> • (Page 2) • <br /> MINE ID # OR PROSPECTING ID # M-81-112 <br /> `IN$pECTION DATE 3/16/99 INSPECTOR'S INITIALS ESC <br /> OBSERVATIONS <br /> This was an inspection of the Builders Aggregate Pit conducted by Erica Crosby of the <br /> Colorado Division of Minerals and Geology. Jim Miner representing Builders Aggregate Company <br /> Inc. was present during the inspection. weather conditions on site were cool and clear. <br /> Ground conditions were dry. A mine identification sign was posted at the entrance to the <br /> site. <br /> The Builders Aggregate Pit is located % mile north of Fort Morgan in Morgan County. The site <br /> is permitted to affect 9.0 acres. A mining and reclamation permit was issued to Builders <br /> Aggregate Co. , Inc. on June 25, 1981. A conversion application was submitted on March 1, <br /> 1995, and withdrawn by the operator on February 22, 1996. The Division currently holds a <br /> reclamation performance bond in the amount of $11,750.00. <br /> The site is located directly south and west of the South Platte River in the natural flood <br /> plane. Permit boundary markers were not located on site. Mining is actively taking place on <br /> the east side of the pit. The pit is being dredged to an estimated depth of 20 feet. Water <br /> enters the pit from cane factory discharge and groundwater recharge. The west end of the pit <br /> was filled in with sediment from the 1995 flood. Flood waters breached through the pit on <br /> the west end depositing sand and silts to an estimated depth of 20 feet. The operator stated <br /> that mining will proceed west. <br /> It was impossible to determine the western pit boundary due to the natural scouring and river <br /> material deposited during the 1995 flood. The area was surveyed using the Global Positioning <br /> System (GPS) based on the recollection of the operator as to the located of the western <br /> extent of mining. The area of the pit was surveyed, and the data was corrected using the <br /> Pathfinder Software. Based on the area traversed, the pit disturbance boundary is roughly 13 <br /> acres. The survey indicates that the operator is 4 acres outside the permit area. However, <br /> without the permit boundary markers in place and remnants of the 1995 flood, is impossible <br /> to determine the western limits of mining. The operator will need to post permit boundary <br /> markers as required by Rule 3.1.12 of the Construction Material Rules and Regulation, and <br /> another site inspection will be required. See page #3 for additional information. <br /> If mining has taken place outside the permit area, the operator may be in possible violation <br /> of C.R.S. 34-32.5-109(1) or 34-32.5-116(4) (i) of the Colorado Land Reclamation Act for the <br /> Extraction of Construction Materials. If the operator has mined, or plans to mine, over 9.9 <br /> acres in size a 112 Reclamation Permit Application will need to be submitted and approved by <br /> the Division.
