Mr. Heintz & Ms. Wynne <br />Duckworth SWSP <br />December 24, 2012 <br />Page 5 of 7 <br />surety amount of the required surety amount of $1,603,000 which can be used to eliminate long <br />term augmentation requirements by lining or backfilling the site should the pit operator or land <br />owner fail to obtain a sufficient augmentation plan after mining operations are complete. <br />Conditions of Approval <br />hereby approve this substitute water supply plan, in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2012 through October 31, 2013, <br />unless otherwise revoked, modified, or superseded by decree. A SWSP renewal request <br />must be submitted to this office with the statutory fee (currently $257) by August <br />31, 2013. <br />2. Well permit no. 63541 -F was obtained for the Duckworth Pit but since mining did not <br />occur and groundwater was not exposed, the well permit expired. A new well permit <br />application was submitted for the current use and exposed pond surface area of the <br />gravel pit in accordance with §37 -90- 137(2) and (11), C.R.S., and is currently pending <br />under receipt no. 3656977. Should this permit be denied for reasons of 600 foot <br />spacing, or any other legitimate reason, approval of this SWSP may be cancelled. <br />3. The total surface area of the groundwater exposed at the site must not exceed 0.45 acres <br />during the approval period of this SWSP, resulting in evaporative losses of 1.15 acre -feet <br />for this plan period. <br />4. The total amount of water used for dust control at the site must not exceed 7.94 acre - <br />feet. All pumping for dust control shall be measured with a totalizing flow meter to the <br />satisfaction of the Division Engineer. <br />5. The total amount of water lost in aggregate production at the site must not exceed 5.37 <br />acre -feet. <br />6. Total consumption at the site must not exceed the aforementioned amounts unless an <br />amendment is made to this plan. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />8. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. The release of replacement water may be aggregated to <br />maximize beneficial use. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />9. Dewatering operations must be measured by totalizing flow meters that can accurately <br />show the monthly volume of water dewatered into the Lighthouse Cove Pond ( "LCP ") <br />and into the Smith & Emmons ditch. The Smith & Emmons ditch must measure the <br />dewatering water diverted directly back to the river. Any dewatering water placed into <br />LCP cannot be used for irrigation or any other purpose by Lighthouse Cove <br />Development or others, and must be allowed to accrete to the stream. The provision in <br />the SWSP allowing LCP to be used as a recharge pond may not be continued in <br />SWSP renewals should it be determined by the water commissioner or division <br />engineer that water within LCP is being diverted for use and accounting is not <br />adequate to show the recharge of dewatering is occurring. <br />
