Response to DRMS Adequacy Review — Cotter CM -25 Mine Reclamation Plan Amendment <br />7. Addressing Rule 6.4.21 (8)(e) - On page T -11, The EPP states that monitoring wells near CM- <br />25 yielded low quantities of water, generally 5 gpm. Please inform the Division of the <br />locations of these wells and their depth to water, as well as their total depths. <br />Depth to water and total depth can be found in Appendix II - Supporting <br />Documents under the "Peel Report" tab. Listed below are the locations of the <br />monitoring wells near the CM -25 mine: <br />CM93 -1: NW 'A of the NW '/4 Section 4, T47N R17W NMPM <br />CM93 -2: SW '/4 of the SW % Section 33, T47N R17W NMPM <br />CM93 -3: SE '/4 of the NW 1/4 Section 33, T47N R17W NMPM <br />8. Addressing Rule 6.4.21 (12) - On page T -16, the EPP states that if water is encountered <br />during mining, and chemical analysis determines that uranium related constituents are above <br />regulatory guidelines, then a monitoring well will be installed. If groundwater is encountered <br />during mining, a monitoring well shall be installed and a monitoring plan shall be established <br />in accordance with this rule, regardless of the results of the chemical analysis. Please commit <br />to this. <br />Cotter commits to installing a monitoring well and establishing a monitoring plan in <br />the event that any water is encountered during mining. <br />9. Addressing Rule 64.21(14) - SPLP tests were conducted in order to characterize the waste <br />rock generated at this site. According to this rule, the ore must also be characterized. Please <br />submit to the Division, a geochemical evaluation of the ore to be mined Alternatively, if ore <br />samples are not available at this time, commit to submitting this information to the Division, <br />for review and approval, prior to any stockpiling on the surface. <br />Prior to ore being stockpiled on the surface Cotter will submit to DRMS a <br />geochemical evaluation of the ore to be mined for its review and approval. <br />10. Addressing Rule 6.4.21 (16) - On page T -23, the EPP states that design and implementation <br />of the Drainage Design Plan will be overseen by a registered professional engineer. Please <br />commit to submitting an "As Built - Certification " to the Division following construction. <br />Cotter will submit an "As- Built - Certification" to the Division following the <br />construction of the Drainage Design Plan facilities. <br />11. Addressing Rule 64.21 (16) - On page T -23, the EPP states that Cotter Corp. will conduct <br />regular inspections of all structures. Please Worm the Division of the anticipated minimum <br />inspection frequency interval. <br />3 <br />
