Response to DRMS Adequacy Review — Cotter CM -25 Mine Reclamation Plan Amendment <br />Cotter Corporation (N.S.L.) (Cotter) submits this response to the October 23, 2012 letter from <br />Dustin Czapla, Division of Reclamation, Mining and Safety ( "DRMS "), to Glen Williams, <br />Cotter. The DRMS' comments are in italics and Cotter's responses are in bold. <br />CM -25 Mine, File No. M- 1977 -307, Amendment (AM1) Application Adequacy <br />Review <br />1. Addressing Rule 6.3.3 (1) (f) — On page C -5 under item a., the exhibit states that waste rock <br />will be stacked to a height that will not impede grading to 2H: IV during reclamation. Please <br />provide the Division with the maximum anticipated thickness that waste rock will be placed. <br />The maximum anticipated thickness of the waste rock pile will be 25 feet. <br />2. Addressing Rule 6.3.3 (1) (f) — On page C -S under item b., the exhibit states that ore will be <br />piled up to a workable stockpile. Please provide the Division with a maximum anticipated <br />amount of ore to be stockpiled at any given time. <br />No more than 1,700 tons of ore will be stockpiled at any given time. <br />3. Addressing rule 6.3.3 (1) — The mining plan proposes to utilize power supplied by a San <br />Miguel Power Association power line, which lies within 200 feet of the Vent Hole #4 affected <br />area, and passes through Vent Hole #2 affected area. The Division believes that there is <br />potential for the SMPA line to be adversely affected by the milling operation. Please submit <br />to the Division, either a notarized agreement between Cotter Corp. and SMPA, that Cotter <br />Corp. is to provide compensation for any damage to the power line caused by the mining <br />operation, or a notarized letter, from SMPA on their letterhead, that the proposed mining and <br />reclamation activities will have "no negative effects" on their power line. <br />A copy of the agreement between Cotter Corporation and SMPA is included in <br />Attachment 1. <br />4. Addressing Rule 6.4.21 (6)(b)(iii) — Please describe how Cotter Corporation will prevent off - <br />site impacts during periods of Temporary Cessation. <br />The current configuration of the waste rock pile is relatively flat and vegetation is <br />well established. Upon approval of the mine permit amendment immediate <br />drainage improvements are recommended for this site. These include grading and <br />installation of improved roadway ditches along portions of the mine access roads, <br />installation of a containment berm along the eastern edge of the site, and excavation <br />of a retention pond with installation of embankments to capture onsite runoff <br />(Onsite Basin 30). A more detailed discussion of these structures as well as maps <br />can be found in Section 7.1 of the Drainage Plan. <br />1 <br />
