the requisite intent and ability to store 1.61 acre -feet for these uses. <br />4. Applicants further request approval of an augmentation plan to allow the above diversions <br />out of priority. To prevent injury to senior water rights holders, Applicant proposes to make available <br />to the stream up to 2.59 acre -foot of water released by the Tri- County Water Conservancy District and <br />the Bureau of Reclamation from Ridgway Reservoir. Applicant will enter into contracts with the <br />District and the Bureau, and pay the annual assessments to make the water available at the discretion <br />of the Division Engineer. This water is stored in Ridgway Reservoir and released to the <br />Uncompahgre River upon call by the Division Engineer. The anticipated demand and depletions <br />pursuant to the operation of the well are shown on Table 1 attached hereto. <br />4. As a result of the operation of the foregoing plan for augmentation, replacement <br />water will be provided to the extent necessary to meet the lawful requirements of, and prevent <br />injury to, senior diverters at the time and location and to the extent senior diverters would <br />otherwise be injured by the operation of the SAKO PUMP and SAKO POND for industrial <br />use (gravel washing, dust suppression, and evaporation for recirculation/settling pond). <br />RULING <br />Applicants are hereby GRANTED a conditional water right for 1.0 c.f.s. of water for <br />industrial use (gravel washing, dust suppression, and evaporation for recirculation/settling <br />pond), from the SAKO PUMP, located as above - described, with an appropriation date of <br />March 20, 2012, adjudication date of 2012. <br />Applicants are also hereby GRANTED a conditional water right for the storage of 1.61 acre - <br />feet of water for industrial use (gravel washing, dust suppression, and evaporation for <br />recirculation/settling pond) in the SAKO POND, located as above - described, with an appropriation <br />date of March 20, 2012, adjudication date of 2012. <br />The proposed SAKO AUGMENTATION PLAN is approved. Prior to the augmentation plan <br />becoming operational, Applicants shall file a copy of the water allotment contract with the Tri- County <br />Water Conservancy District for at least 2.59 acre -feet per year with this Court and the Division <br />Engineer. <br />Applicant must line the SAKO POND in accordance with the August 1999 State Engineer's <br />Guidelines for Lining Criteria for Gravel Pits prior to diverting any Uncompahgre River water into <br />the SAKO POND from the SAKO PUMP. <br />Pursuant to C.R.S., 37- 92- 305(8), the State Engineer shall curtail all out -of- priority <br />diversions, the depletions from which are not replaced as to prevent injury to vested water rights. <br />Applicant is on notice that the supply contract with the District may be limited. If the contract should <br />fail and an alternative source of replacement water is not made available pursuant to a modification of <br />this decree, curtailment of all out -of- priority diversions from the structures will occur. <br />
