Of ONO <br />RECEIVED -rct <br />DEC 242012 <br />Division of Reclamation, <br />Mining & Safety <br />On June 10, 2011 you submitted an application to develop federal mineral materials in Township <br />18 North, Range 70 East, Sections 30 and 31. <br />A National Environmental Policy Act (NEPA) Environmental Analysis was conducted to <br />provide an in -depth review of this mining proposal. The Draft Environmental Analysis document <br />was provided to the public for review and comment during the period of October 4, 2012 through <br />November 8, 2012. At the conclusion of this analysis and public review period, a finding of no <br />significant impact was reached and the record of decision was signed on December 20, 2012. <br />Subsequently, the mineral materials application is being approved with the understanding that <br />the mitigation measures identified during the Environmental Analysis process will eventually be <br />incorporated into the mineral materials contract. <br />In accordance with 43 CFR 3602.31, sales in excess of more 200,000 C.Y. (or weight equivalent) <br />will be conducted under a competitive sale process. As this requested sale is in excess of this <br />amount, provisions for competitive sales outlined under 43 CFR 3602.40 will need to be <br />followed. It is anticipated that competitive sale will be held in early 2013 and will be conducted <br />through sealed bidding, with the contract having the option to be renewed. Providing proof of <br />access will be one of the required elements for bid selection. <br />On September 20, 2011 BLM received cost recovery in the amount of $5,045.15 from T.H.E. <br />Aggregate Source mine, in order to process this application for disposal of federal mineral <br />materials located. The actual cost to process the application amounted to $10,694.27. Therefore, <br />the applicant is required to pay the difference of $5,649.12. If the successful bidder is someone <br />other than the applicant, they will be required to submit the cost recovery fee amount and the <br />applicant will be reimbursed. <br />
