Berger <br />Field Manager <br />Royal Gorge Field Office <br />LF <br />RECEIVED <br />r 24 2012 <br />Division of Reclamation , <br />Mining <br />After fully reviewing this submittal, it has been determined that your notice is complete and accepted. <br />On December 4, 2012, BLM received Notice from Angela Bellantoni (Environmental Alternatives Inc) of <br />Zephyr Gold USA Ltd.'s intent to conduct exploration activities in TI9S, R71 W, Section 14 in Fremont <br />County, CO. BLM has reviewed the notice and per 43 CFR 3809 is responding within the regulatory required <br />timeframe of 15 days. <br />Based on the review of data that is currently available, there does not appear to be a direct conflict with <br />archeological sites or threatened and /or endangered species and their habitat within the proposed disturbance <br />boundary. Although not currently identified, continued awareness during project implementation is critical so <br />cultural resources are not inadvertently disturbed or destroyed. Regulations outlined in 43 CFR 3809.420 <br />provide further details on performance standards that also apply to your notice operation, which include those <br />related to cultural resources and threatened or endangered species. <br />In accordance with 43 CFR 3809.312(c), a financial guarantee must be submitted prior to beginning exploration <br />operations. Our office will coordinate with the Colorado Division of Reclamation, Mining and Safety regarding <br />the warranty calculation associated with this proposed project. If mining activities are proposed as a result of <br />this exploration project (or any other conditions are met under 43 CFR 3809.11), then BLM needs to be notified <br />and compliance with 43 CFR 3809.400 will be required. <br />
