• No overstory or understory vegetation will be removed from the riparian zone of the <br />streams in the Terror Creek watershed. <br />• During construction or maintenance activities in proximity to the 200 -foot riparian buffer <br />zone, the edge of the buffer zone shall be marked for avoidance by construction <br />equipment and activities. <br />• Within the Terror Creek watershed only fresh water, free of chemicals or other <br />contaminants, may be used for dust abatement activities. <br />• Within the Terror Creek watershed, additional crossings of perennial streams will not be <br />constructed. <br />• The BLM Uncompahgre Field Office hydrologist must approve, in advance, the size and <br />composition of riprap material to be used in the East Fork of Terror Creek. <br />• Bowie must report their annual water depletions to the BLM Uncompahgre Field Office <br />by September 30 each calendar year. This includes depletions that result from surface <br />activities associated with coalmining related activities within the Action Area, regardless <br />of surface ownership. <br />• Conditions which will trigger re- initiation of consultation with the USFWS are: <br />1. The types of impacts associated with the proposed actions differ from, or exceed <br />those evaluated in this BA. <br />2. In the future, species that could be impacted by Bowie's activities in the Action <br />Area are added to the list of Threatened or Endangered species. <br />3. Surface disturbance within the Terror Creek watershed exceeds 71.4 acres. <br />4. Bowie submits to BLM requests for exceptions to the conservation measures of <br />this BA. <br />5. If future genetic information results in a change in GBCT's status as Threatened <br />under the ESA, the conservation measures contained in this BA will be reviewed <br />and updated as appropriate. <br />• Bowie Best Management Practices (Appendix A of BLM (2011)), including erosion/ <br />sedimentation control measures, will be applied to project activities. <br />Page 5 <br />
