Pineda <br />Hotchkiss, CO 81419 Director <br />Re: Terror Creek Loadout (Permit No. C- 1983 -059) <br />Permit Renewal Application No. 6 (RN -6) <br />Dear Sir or Madame: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on December 21, 2012, an application to renew an <br />existing permit to conduct coal mining operations at the Terror Creek Loadout was considered complete for the <br />purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and <br />the Rules initiate from this date of filing. <br />The applicant, Terror Creek, LLC, proposes to continue Loadout coal mining operations on land located approximately <br />4 mile(s) Northeast of Paonia, Colorado. The permit area is further described as follows: <br />Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M. <br />The above - mentioned tracts of land are shown on Bowie USGS 7.5 minute Quadrangle. <br />Terror Creek, LLC has submitted a complete permit renewal application for the Terror Creek Loadout. Terror Creek <br />has submitted the Permit Renewal application within 180 days of the permit's expiration and has retained the right of <br />successive renewal pursuant to Rule 2.08.5. This is a renewal only application and Terror Creek is not proposing any <br />changes to the loadout's current operations. There are no proposed changes to the mines permit, affected or <br />disturbance boundaries. The Division will evaluate the ladout°s reclamation liability as a result of the renewal <br />application. <br />A copy of the renewal application is available for public inspection at the Delta County Clerk and Recorder, 501 <br />Palmer Street, Room 211, Delta, CO 81416, and at the Division office.
