Pineda 501 Palmer, Suite 227 Director Delta, CO 81416 Re: Terror Creek Loadout (Permit No. C- 1983 -0-59) Permit Renewal Apolication No. 6 (RN -6) Dear Delta County Commissioners: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on December 21, 2012, an application to renew an existing permit to conduct coal mining operations at Terror Creek Loadout was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. Terror Creek, LLC proposes to continue Loadout coal mining and/or reclamation operations on land located approximately 4 miles Northeast of Paonia, Colorado. The permit area is further described as follows: Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M.. The above - mentioned tracts of land are shown on Bowie USGS 7.5 minute Quadrangle. Terror Creek, LLC has submitted a complete permit renewal application for the Terror Creek Loadout. Terror Creek has submitted the Permit Renewal application within 180 days of the permit's expiration and has retained the right of successive renewal pursuant to Rule 2.08.5. This is a renewal only application and Terror Creek is not proposing any changes to the loadout's current operations. There are no proposed changes to the mines permit, affected or disturbance boundaries. The Division will evaluate the ladout°s reclamation liability as a result of the renewal application. A copy of the renewal application is available for public inspection at the Delta County Commissioners, 501 Palmer, Suite 227, Delta, CO 81416.
