Therefore, a 404 <br />permit will not be required to mine through this area. <br />Fish and Wildlife: <br />The Division observed prairie dogs at the north side of the pits. In addition, the Division observed a Golden <br />Eagle hunting north of the pits. Despite the mining related activity, the site continues to provide valuable <br />wildlife habitat. <br />Reclamation Success: <br />According to the 2012 Annual Report, the Operator has backfilled 74.7 acres, graded 191.5 acres and seeded <br />and mulched 209.4 acres. The Division inspected portions of the reclaimed area which are located south of the <br />pits and north of the Poudre Valley REA substation. The vegetation appears to be well established and no signs <br />of erosion were noted. Weed management is ongoing; the Division did not observe any areas which were <br />infested by noxious weeds. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $3,177,550.00. The bond was last calculated <br />in 2009 as part of the approval of Technical Revision No. 2. The Division has recalculated the bond amount as <br />part of this inspection; the bond calculation has been enclosed with this report. Notice of any increase to the <br />financial warranty will be sent under separate cover. <br />The Operator has done an excellent job in operating the site in a clean and orderly manner; no problems or <br />possible violations were noted. <br />This concluded the inspection. <br />Page 3 of 5 <br />
