COMPARISON SHOULD BE IN THE FORM OF INFILTRATION, PERMEABILITY AND <br />TEXTURE STUDIES. <br />Stipulation No. 53 <br />BEFORE MINING RESUMES, BRL WILL SUBMIT, AND OBTAIN DIVISION APPROVAL FOR, <br />A REVISION THAT ADDRESSES THE PLANNED MINING SEQUENCE FOR THE REMAINDER <br />OF THE EXISTING PERMIT TERM. <br />Since the loadout has not been reclaimed, Stipulation No. 26 will remain active. Stipulation No. 53 was <br />placed on the Division's decision to approved Permit Renewal No. 5 (RN -05). At the time of the <br />renewal, the mine had been in temporary cessation since December 4, 1997. BRL subsequently closed <br />the mine permanently and initiated reclamation of the site in 2000. With the exception of the loadout <br />area, activities currently approved at the site are for reclamation only and no mining activities are <br />contemplated. Accordingly, Stipulation No. 53 is terminated with the approval of this permit renewal <br />application. <br />No new stipulations have been imposed since the 2010 midterm review. <br />Summary of Revisions since the 2010 Midterm Review <br />Since the Midterm Review was conducted by the Division on October 15, 2010, Bowie Resources, LLC <br />has submitted two minor revisions, one technical revision, one permit revision and a bond release <br />request. <br />Permit Revision No. 4 was approved on January 13, 2011. The revision reduced the permit area by <br />3,339 acres, removing 960 undisturbed and unaffected acres from the Bowie No. 1 permit area and <br />transferring 2,379 acres from the Bowie No. 1 permit area to the Bowie No. 2 permit area. <br />Minor Revision No126 was approved by the Division on January 24, 2011. The revision included <br />updates to the permit application package required by the October 15, 2010 midterm review. <br />Minor Revision No. 127 was approved by the Division on June 15, 2011. The revision allowed for the <br />drilling of three gob vent boreholes. <br />Technical Revision No. 54 was approved on October 9, 2012. The revision included a revised design for <br />Ditch 7 on the east side of the East Mine. <br />Surety Release No. 4 was submitted to the Division on March 14, 2012. The bond release application <br />requests Phase I bond release on 70 acres of regraded disturbed lands, and is currently under review. <br />Brief Permitting History <br />The Bowie No. 1 Mine was an underground mine which began operating in 1975 and was permitted <br />under the permanent state regulatory program in 1981. The mine was originally called the Orchard <br />Valley Mine and the original permittee of the 1981 permit was Colorado Westmoreland, Inc. (CWI). <br />The permit has been transferred twice; first to Cyprus Orchard Valley Coal Corporation and then to <br />Bowie Resources, LLC. <br />Page 5 of 42 <br />
