December 11, 2012
Susan L. Burgmaier
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
Dear Ms. Burgmaier:
HISTORY
Re: Bowie No. 2 Mine (Permit No. C- 1996 -083), Technical Revision No. 76 (TR -76), Expansion of Coal Mine
Waste Pile No. 2 (CHS #63156)
Thank you for your correspondence dated November 26, 2012 (received by our office on November 28, 2012)
regarding the subject project.
Following our review of the documentation provided supplemented with information available on the Division
of Reclamation, Mining and Safety (DRMS) WebLink site, it is our opinion that a finding of no historic
properties affected is appropriate for the proposed undertaking.
In the future, please include a map showing the area of potential effects (APE) as stipulated in the 1991 MOU
between our offices. Appropriate documentation should include a portion of a 7.5- minute USGS topographic
map, but any map that clearly indicates the extent of the APE in relation to section boundaries will likely be
sufficient for review purposes.
If previously unidentified archaeological resources are discovered in the course of the project, work must be
interrupted until the resources are properly evaluated in terms of the National Register of Historic Places
eligibility criteria (36 CFR 60.4) in consultation with our office.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Mark Tobias,
Section 106 Compliance Manager, at (303) 866 -4674 or mark.tobias c@istate.co.us.
Sincerely,
a
6 ,....._ , Edward C.
