C- 1981 -022 <br />PR -7 Findings <br />October 4, 2012 <br />D. Sedimentation Ponds <br />Disturbed areas in the main facilities area and yard are treated by two sediment <br />ponds, Ponds A and B. Pond C controls sediment from the approved West <br />Valley Coal Refuse Facility. Pond D treats runoff from the disturbed areas <br />developed up the Elk Creek Canyon for the Elk Creek Mine. Pond E controls <br />sediment from the approved II West Coal Refuse Facility. The Hubbard Creek <br />Pond controls sediment from the Upper Hubbard Creek facilities area, and the <br />East Yard Pond controls sediment from the east yard of the Elk Creek facilities <br />yard. One additional pond was approved for treatment of underground <br />discharge from the Sanborn Creek portals and will be retained for use with the <br />water treatment plant for the town of Somerset. Specific plans are found within <br />section 6 of Exhibit 2.05 -E3, volume 10 of the permit document. All ponds <br />are designed in compliance with Rule 4.05.6. <br />E. Acid - forming and Toxic - forming Spoil <br />There is no evidence of acid- or toxic - forming material at this site. <br />F. Impoundments <br />Refer to Section D, Sedimentation Ponds, above. <br />G. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved <br />by the Division. The ground water monitoring plan is specified on Page 2.04 - <br />41of the permit document (4.05.13(1)). <br />2. The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) and <br />as specified on page 2.05 -46iii of the permit document (4.05.13(2)). <br />L Discharge of Water into an Underground Mine <br />Discharge of water to underground workings will not occur. <br />J. Stream Buffer Zones <br />The Division has approved surface and underground mining activities within <br />100 feet or through perennial streams. This decision was based on a finding <br />that on Hubbard Creek the original stream channel will be restored, water <br />quality and quantity shall not be adversely affected, and appropriate riparian <br />22 <br />
