Stover and Associates, Inc. <br />Mike King <br />2352 North 7th Street, Unit B. <br />Executive Director <br />Grand Junction, Colorado 81501 <br />Loretta Pineda <br />Director <br />RE: Hamilton Mine; C- 1991 -078 <br />Phase III Bond Release (SU), Adequacy Review No. 3 <br />Dear Mr. Stover, <br />The Division received your December 3, 2012 letter in regards to the monitoring wells and your November 15, <br />2012 letter in response to the Divisions October 25, 2012 adequacy review letter. The current decision date for <br />the SL3 bond release is December 31, 2012. There are several remaining items that must be addressed prior to <br />the Divisions approval, the purpose of this letter is to summarize the outstanding adequacy review items and <br />outline what has been resolved at this point. <br />DRMS, June 12, 2012 Adequacy Review Letter <br />1.) Item No. 1 in regards to the water monitoring plan. On October 5, 2012 the Division received the results of <br />the ground water monitoring conducted at the site. The response is adequate and this item is considered resolved. <br />2.) Item No. 2 in regards to monitoring well abandonment. On December 5, 2012 the Division received <br />abandonment reports for 13W -2, AW -1, AW -2 and AW -3. Also discussed in this letter is the status of AW -4, <br />AW -5, AW -6, AW -7, BW -1 and 13W -3. The abandonment reports submitted for 13W -2, AW -1, AW -2 and AW -3 <br />are adequate. <br />It appears the Operator is in the process of transferring wells AW -6, AW -7, BW -1 and 13W -3 to the landowners <br />where the wells are located. In accordance with Rule 4.05.14, please submit evidence that well permits have been <br />obtained from the State Engineer for each of these monitoring wells. Also, the Operator and the surface owner of <br />the lands where the wells are located must jointly submit a written request for approval of the transfer to DRMS <br />(Rule 4.05.14(2)). Finally, according to the December 5, 2012 letter, wells AW -4 and AW -5 were likely <br />destroyed during a high run -off event. Since the Division could not locate wells AW -4 and AW -5 with certainty <br />during the bond release inspection, it will accept this response and require no further action by the Operator. <br />3.) Item No. 3 in regards to weed control. On November 26, 2012 the Division received an e -mail from you <br />indicating weeds have been sprayed. Please provide documentation to the Division the weeds have been treated. <br />This could include photographs and herbicide receipts. <br />4.) Item No. 4 in regards to re- seeding Sediment Pond A. On November 26, 2012 the Division received an e -mail <br />from you indicating the seed has been purchased for the Pond A area but the area had not been seeded yet.
