In addition, the Surface <br /> Water Control Plan, as reviewed in Section 2.05.3, will prevent any <br /> pollutants occurring with the mining operation from affecting or <br /> impacting the adjacent alluvial valley floor. <br /> CF&I Steel Corporation has operated the Maxwell Mine in its present <br /> location since 1977. All facilities, mine plan, and construction <br /> activities, both surface and underground, have been completed based on <br /> the expected extraction of coal by underground methods at the Maxwell <br /> Mine for the next 40 or more years. Continued operation of the mine in <br /> the vicinity of the alluvial valley floor is necessary to meet the coal <br /> requirements for CF&I Steel Corporation' s steel operations at Pueblo, <br /> Colorado. <br /> Operation of the Maxwell Mine, as described in Section 2.05.3, is <br /> "grandfathered" under the existing Colorado Regulations for Coal Mining <br /> in or adjacent to alluvial floors. Justification of "grandfathering" is <br /> through the following points: <br /> • The Maxwell Mine began producing coal in commercial <br /> quantities in March, 1977. <br /> • Substantial and significant financial commitments were made <br /> prior to August 3, 1977, predicated on CF&I Steel Corpora- <br /> tion's ability to mine coal within and adjacent to an <br /> alluvial valley floor. <br /> These commitments are based on, and evidenced by, the approval of <br /> Special Use Permit by Las Animas County Board of Commissioners on <br /> January 30, 1976, covering the Life of Mine Boundary, as shown in <br /> Exhibit 22. CF&I Steel Corporation requests that the Colorado Mined <br /> Land Reclamation Division make a specific finding that the Life of Mine <br /> Boundary for the Maxwell Mine is "grandfathered" for continued operation <br /> in and adjacent to an alluvial valley floor as provided by the <br /> Regulations for Coal Mining. <br /> 2.06-3 <br />
