THIS LICENSE, made and entered into this 25th day of
February , 1970, by and between CF&I STEEL CORPORATION,
a Colorado corporation, hereinafter referred to as the "Licensor",
and THE CITY OF TRINIDAD, a municipal corporation of the State
of Colorado, hereinafter referred to as the "Licensee";
A I T N E S S E T H:
In consideration of the premises, the respective
undertakings of the parties hereto, and the payment by the
Licensee of Six Thousand Eight Hundred Twenty and 63/100
Dollars ($6,820.63) unto the Licensor, the receipt whereof
is hereby confessed and acknowledged, it is hereby agreed as
follows:
1. The Licensor agrees that the Licensee shall have
and hereby grants to the Licensee, upon terms and conditions
herein set forth and subject to the performance by the Licensee
of its obligations hereunder, a license to construct, reconstruct,
operate and maintain on lands of the Licensor certain facilities
described and located as follows:
A Class I, 18" diameter ductile iron water
transmission line being 1,664.125 rods in length,
the top of such line being laid at least 30 inches
below the natural ground line, which facilities
shall be located upon lands owned by the Licensor
as more particularly described in Appendix A
attached hereto and incorporated herein by this
reference.
2. The Licensee shall have the right to construct
and maintain on lands of the Licensor only the facilities above
described and shall have the right to trim trees and shrubbery
only if such trees or shrubbery should materially interfere
with or endanger the proper operation and maintenance of said
facilities. This license shall not be deemed to give the
Licensee exclusive possession of any part of the Licensor's
premises.
