Climax identified this dam as an Environmental Protection <br /> Facility in the August 11, 1995 Environmental Protection Plan for this facility. Pursuant to <br /> Section 7.2 of the Minerals Rules and Regulations, we hereby submit these documents for <br /> review and approval by the Division. <br /> I have also attached a copy of a July 14, 1995 letter from the Mr. Alan Pearson of the Dam <br /> Safety Branch of the Colorado State Engineer. This letter cites completed state review and <br /> approval for the project. Climax has retained Mr. Douglas Seely, P.E. of W.W. Wheeler and <br /> Associates to conduct inspection, QA/QC, and project oversight. Mr. Stephen Spann from the <br /> Office of the State Engineer is currently working with W.W. Wheeler, Climax, and the contractor <br /> ASI/RCC of Buena Vista, Colorado, toward certification of this facility. <br /> A final attachment shows the proposed schedule for installation of the outlet works. You will note <br /> that our operations group has targeted September 18, 1995 for initiation of construction on the <br /> Dam following site prep and mobilization next week. Climax will, however, look to your review <br /> and approval under requirements of the Environmental Protection Plan. I believe the State <br /> Engineer may be able to provide dual certification to meet both dam safety and environmental <br /> protection requirements. <br /> Thank you in advance for your review.
