In accordance <br /> with your letter dated November 16, 1995, it is the Division's <br /> understanding that you intend to provide your responses by February 1, <br /> 1996, or, if you anticipate any difficulty in meeting the February 1, 1996 <br /> date, the Division will be notified by January 15, 1996. I do apologize <br /> that the Division's review took more time than we had originally <br /> anticipated, and thank you for the efforts of everyone involved in the <br /> preparation of your Environmental Protection Plan (EPP) application. <br /> 1. The Division concurs with the proposal in section 1. 1.2 of the EPP <br /> application on how to handle changes in referenced information and <br /> documents, however, in accordance with Rule 8.3 of the Mineral Rules <br /> and Regulations, updates to the Emergency Response Plan involving <br /> responsible personnel and their phone numbers, or involving the list <br /> and location map of materials, supplies and equipment for <br /> containing, controlling and cleaning up of designated chemicals, <br /> must be provided to the Division prior to implementation of any <br /> changes. <br /> 2 . The EPP application identifies the ore body beneath Bartlett <br /> Mountain at the Climax Mine as acid forming material. Data included <br /> in Appendix C to the EPP indicates that Climax Mine overburden and <br /> country rock also has acid forming potential. As such, and in <br /> accordance with Rule 6.4. 19 (2) , map(s) , Sketch(es) , plan(s) , or <br /> other equivalent representations must be provided that depict the <br /> lateral and vertical extent of the workings. <br /> 3 . Rule 6.4. 19 (10) (b) requires that a copy of the site Storm Water <br /> Management Plan (SWMP) be provided with the EPP. The Division has <br /> requested a copy of the Climax Mine SWMP as part of the adequacy <br /> review for the ground water technical revision (TR-08) . Submittal <br />
