A-1(91“ ouleiz- <br />Date: (\kV 4/m b0 r ell, 2012 <br />To INDIAN HILLS, LLC: <br />This agreement between TONY J BELTRAMO & SONS, INC., the operator of the <br />PHEASANT RUN GRAVEL PIT engaged in the activity of gravel mining and INDIAN <br />HILLS, LLC, 1202 W. 24 STREET, PUEBLO, COLORADO 81003. This agreement <br />will cover the High Line Canal and all other man-made structures such as fences, <br />culverts, gates, etc. operations in the SW'/ of Section 32, Township 21 South, Range 60 <br />West, of the 6 P.M., Pueblo County, State of Colorado. <br />This agreement is to provide that TONY J BELTRAMO & SONS, INC. can carry on <br />normal gravel mining activities within the property and within the MLRB Permit <br />Boundary Line. It also provides that any damage caused by the mining operation to <br />INDIAN HILLS, LLC fences, gates and/or structures, equipment or improvements will <br />be compensated by TONY J BELTRAMO & SONS, INC. to INDIAN HILS, LLC. This <br />agreement is to comply with Rule 6.4.19 of the Colorado Division of Reclamation, <br />Mining and Safety, Land Reclamation Board Rules and regulations dealing with any <br />adverse affect on any significant, valuable or permanent man-made structure within 200 <br />feet of the affected land. <br />This agreement shall be binding on the Heirs, Successors and assigns of TONY J <br />BELTRAMO & SONS, INC. and INDIAN HILLS, LLC. <br />IN WITNESS WHEREOF, This Agreement has been executed to, this day of <br />November , 2012. <br />INDIAN S, LL,C <br />By: <br />M.. ager Charles .
