Pineda <br />Director <br />The Division has reviewed Bowie Resources, LLC's (BRL) response to the Division's <br />adequacy concerns with the technical revision application submitted for the as -built <br />configuration of Gob Pile #4, and has the following comments. <br />Rule 2.05.3(4) — Operations Plan for Ponds, Impoundments, Other Treatment Facilities and <br />Diversions <br />1. This item has been addressed. <br />2. This item has been addressed. <br />3. This item has been addressed. <br />Rule 4.10.4 Coal Mine Waste Banks — Construction Requirements <br />4. The Division's initial review of the as -built topography provided with the TR -75 <br />application indicated that portions of Gob Pile 94 were constructed with steeper slopes <br />than what was approved in the original design for the pile. On an attached map <br />(attached hereon for your reference), we identified areas of the slope that appeared to <br />be between 2.0 H:1 V and 2.5 H:1 V, and other areas that were steeper than 2.0 H:1 V <br />(blue -green areas). <br />BRL contracted Buckhorn Geotech, Inc. to further examine the stability of the refuse <br />area. Buckhorn has conducted a revised As -Built Stability Analysis, and determined <br />that slopes as steep as 2.0 H: IV will provide the required Minimum Factor of Safety <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
