OBSERVATIONS <br />PERMIT #: M- 2004 -030 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: October 11, 2012 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Bill Tenore of T Bone Stone, Inc. was also present for the inspection. The T Bone Stone Quarry is <br />located approximately 5 miles north of Lyons, CO. The site is permitted for 9.9 acres with a maximum allowed <br />disturbance of 8 acres. The post- mining land use is rangeland. <br />On April 25, 2012 the Division conducted an inspection of the T Bone Stone Quarry and found that the <br />Operator had affected 0.71 acres outside of the permit boundary. The Mined Land Reclamation Board found <br />the Operator in violation of C.R.S. 34- 32.5- 116(4)(i) for failure to protect areas outside of the affected land <br />from slides or damage occurring during the mining operation and reclamation. The Operator was ordered to <br />submit a Conversion Application to modify the permit /affected area to incorporate the entire disturbed area. <br />The Division received the Operator's Conversion Application on July 30, 2012. The Division conducted this <br />inspection to field verify the information provided in the application, including confirming the presence of <br />permanent man -made structures. In addition, the Division will determine whether there are any site specific <br />environmental concerns which have not been addressed in the application. <br />The Operator is seeking to expand the sandstone quarry by 15.1 acres for a total permit area of 25 acres. The <br />existing permit area is comprised of three separate permit boundaries. The proposed permit area will fall <br />under a single permit boundary which will encompass the existing quarry areas; all of the acreage to be added <br />is on land owned by the Permittee. Under the proposed application, the area to be mined will be increased, <br />but the scale of the Operation will remain the same. Currently the Operator has two quarry areas open. The <br />stone is cut to dimension and loaded onto pallets in the storage area, which is located between the two <br />quarries. Topsoil depth ranges from zero to several inches; upon final reclamation topsoil will be screened <br />from overburden stockpiles and replaced onto the disturbed areas. Overburden stockpiles will be located <br />around the perimeter of the quarries. There will be no substantial changes to the Mining or Reclamation Plans. <br />The Operator had marked the boundaries of the proposed operation and had posted notice of the Conversion <br />Application as required by Rule 1.6.2(1)(b). The Division observed an overhead powerline which bisects the <br />quarry. This structure was not included on the Mining or Reclamation Plan Maps; the Operator was informed <br />that the maps would need to be revised to include this structure. In addition, the Operator must obtain a <br />damage waiver agreement with the owner of the utility or demonstrate through an engineering analyses that <br />the structure will not be affected by the mining operation. The Operator will continue to use the existing <br />access road for the operation; no new roads will be constructed. There are no surface water bodies on the <br />property and it is not anticipated that the operation will have any impact to the quality or quantity of <br />groundwater. <br />The Division holds a financial warranty in the amount of $20,000.00. A complete bond calculation will be <br />performed according the proposed Mining and Reclamation Plans; notice of any increase to the financial <br />warranty will be sent under separate cover. <br />The Division did not make any observations which would prevent the approval of the Conversion Application. <br />This concluded the inspection. <br />Page 2 of 3 <br />
