Letter to Bryce Romig 5 April 6 1998 <br /> delivery of water that would cause the standards to be exceeded to the Eagle River Basin. <br /> CONDITION NO. 3 <br /> Water quality analytical results obtained during periods of water delivery from Eagle Park Reservoir <br /> must be provided to the Division, via facsimile transmission and regular mail, within five business <br /> days of receipt by Climax Molybdenum Company. <br /> CONDITION NO. 4 <br /> CMC understands that additional conditions to approval of SR-002 may develop from a site inspection <br /> to be conducted by the Division as soon as weather and ground conditions permit. <br /> As discussed in the Division's letter dated January 9, 1998,the Division will inspect grading work on <br /> the road above the steep slope at the south side of Eagle Park Reservoir as soon as weather and ground <br /> conditions permit. The Division will also inspect the surge pond and related storm water controls at <br /> the Robinson ground water cutoff wall at the same time. In accordance with Rules 4.16.1(5), 4.16.3, <br /> and 4.16.5 of the Hard Rock/Metal Mining Rules and Regulations of the Mined Land Reclamation <br /> Board,the Division will notify CMC of its decision on revision SR-002 within sixty days of the date of <br /> that inspection. As such, the as yet to be determined date sixty days following the date of the <br /> Division's inspection is the working decision date for revision SR-002. However, as also discussed in <br /> the Division's January 9, 1998 letter, CMC may obtain conditional approval of revision SR-002 prior <br /> to the working decision date. This conditional approval may be obtained by agreeing to the Division's <br /> suggested monitoring plan as detailed in this letter, and by agreeing to the Division's proposed <br /> conditions for approval listed above. <br /> If you have any questions, please contact me. <br /> Sincerely, <br /> Allen C.
