Climax Molybdenum Company (CMC) appreciates the Division's
continued review and evaluation of the Eagle Park Reservoir project. We believe that the
following information and clarification will assist the Division in confirming source removal
with an appropriate level of supporting operational and monitoring activities.
In item number 1 of the January 9, 1998 letter, the Division discusses slope stability and
monitoring on the south edge of the reservoir. CMC has had the Division's suggested
program reviewed by our consultants. This review, containing recommendations that
support the Divisions suggested program, is attached. The recommendations are consistent
with Division suggestions but define more discreet time frames and targets. In addition,
movements in the slope greater than 0.2 feet would be reported within a week following
confirmation of the surveyed reading. If the attached review is amenable to the Division,
CMC is willing to follow the refined recommendations of our consultant. Also with respect to
item number 1, CMC accepts the Division's requirement to inspect surface water diversions
in the vicinity of the south edge of the reservoir.
Item number 2 addresses Environmental Protection Facilities for Eagle Park Reservoir. CMC
accepts the Division's requirement to inspect surface water diversions and maintenance
activities in the vicinity of the Robinson Lake Seepwater Collection System including the
surface water pumping facility and the Robinson Seep Cut-off Wall. In addition, CMC feels
that written acceptance of the 4-Dam Seep Return System is required for final confirmation
of the suitability of established Environmental Protection Facilities to protect Eagle Park
Reservoir. Please refer to correspondence sent to the Division by CMC on November 24,
1997, certifying installation of the pressure drop indicators at the 4-Dam Seep Return
Station. CMC believes that required submittals for the 4-Dam Seep Return System are
