The Division also concurs that this activity does not require a CDPS
discharge permit, and is subject to the Conditions of Approval under the jurisdiction of the Colorado Division
of Minerals and Geology (CDMG).
Tthe Division would like to clarify its position regarding antidegradation as was discussed under Condition No.
1. The Division has determined that antidegradation requirements are not a regulatory requirement for this
particular activity; however, an antidegradation review could be utilized as a tool for assessment of the water
quality impacts of the water releases from Eagle Park Reservoir to the Eagle River.
If you have any other questions or concerns regarding the conditional approval of CDMG, please either contact
me at (303)+692-3598, or Don Holmer at (303)+692-3601. The Division appreciates the opportunity to
comment on the proposed Conditions for Approval, as well as the good coordination efforts that have been made
with CDMG and Climax on this issue.
Si erely,
Phil Hegeman anager
Permits Unit
WATER QUALITY CONTROL DIVISION
cc: Don Holmer,Permits Unit,WQCD
Jim Chubrilo,WQCD-Steamboat Springs District Office
Ann Bererle, Climax Molybdenum Company
Pat Nelson, CH2M Hill
Mike Reed,Environmental Protection Agency
Lake County Health Department
Climax Molybdenum Company,Climax Mine permit MS-3 file,CO-0000248
