Emmons Sludge Disposal) , Climax Mine, File <br /> No. M-77-493 <br /> Dear Mr. Zancanella: <br /> The Division has reviewed the TR-006 submittal and has identified the following <br /> issues as requiring clarification: <br /> 1. Are any permits or licenses required for the commercial carrier to <br /> transport the Mt. Emmons-Keystone Mine precipitate from Gunnison County to <br /> the Climax site? <br /> 2. Please provide a detailed description of the procedure used to assimilate <br /> the Mt. Emmons-Keystone Mine precipitate into the Climax Mine water <br /> precipitate. The Division is interested in the potential for re- <br /> mobilization of metals from the fixed precipitate during the assimilation <br /> process. <br /> 3. The Division believes that disposal of Mt. Emmons-Keystone Mine <br /> precipitate in the Climax tailing ponds will require a Certificate of <br /> Designation (CD) under the Solid Waste Disposal Facilities Act. Enclosed <br /> are copies of the current Memorandum of Understanding (MOU) between the <br /> Colorado Department of Health and the Division concerning solid waste <br /> issues, as well as a draft of the proposed supplementary MOU. These <br /> documents should clarify the Division's position. Approval of TR-006 will <br /> be conditional with the stipulation that Climax obtain a CD for disposal <br /> of the Mt. Emmons-Keystone Mine precipitate. <br /> Please provide responses to the foregoing items prior to the January 25, 1994 <br /> decision date for TR-006. <br /> If you have any questions, please contact me. <br /> Sincerely, <br /> Allen C.
