Pineda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on November 23, <br />2012, an application to renew an existing permit to conduct coal mining operations at the New <br />Horizon Mine was considered complete for the purposes of filing. All review and comment <br />periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from <br />this date of filing. <br />Western Fuels - Colorado, LLC proposes to continue Surface coal mining and /or reclamation <br />operations on land located approximately 1.7 miles Northwest of Nucla, Colorado. The permit <br />area is further described as follows: <br />Sections 25 and 36, Township 47 North, Range 16 West; Section 31, Township 47 North, Range <br />15 West; Section 6, Township 46 North, Range 15 West; and Section 1, Township 46 North, <br />Range 16 West. <br />The above - mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla. <br />No modifications to the existing permit have been proposed with this renewal application. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, <br />we must have your concurrence in order to approve this proposal. We are required to make a <br />finding that "the proposed operations will not adversely affect any publicly owned park or place <br />listed on or those places eligible for listing, as determined by the SHPO, on the National Register <br />of Historic Places, unless approved jointly by the Board and the Federal, State, or local agency <br />with jurisdiction over the park or place." Therefore, we request that you submit comments <br />regarding your concurrence with, concerns with, or objections to this proposal.
