Box 1180 <br />Alma, CO 80420 <br />STATE OF COLORADO <br />RE: Reason to Believe a Violation Exists at Gloria Z Mine; DRMS File No. <br />M- 1984 -094 <br />Dear Mr. Pfister, <br />Mike King <br />Executive Director <br />Loretta E Pineda <br />Director <br />On November 2, 2012 the Division received Technical Revision No. 1 which updated the Mining <br />Plan for the Gloria Z Mine. Included in Technical Revision No. 1 was a revised Mining Plan <br />Map which depicted areas of disturbance outside of the permit boundary. <br />A total of 1.49 acres of land outside of the permit boundary has been disturbed by the mining <br />operation. <br />Based on these findings we believe that this is a violation of: <br />C.R.S. 34- 32.5- 116(4)(i) for failure to protect areas outside of the affected land from slides <br />or damage occurring during the mining operation. <br />Therefore, we have reason to believe that a violation exists to DRMS File Number M- 1984 -094 <br />and to the Law, and have scheduled this matter to appear before the Mined Land Reclamation <br />Board. <br />A Formal Public Hearing will be held during the January 9 and 10 2013 Board Meeting for <br />consideration of a possible violation. The hearing will be held in Room 318 of 1313 Sherman <br />Street, Denver, Colorado, beginning at 9:00 a.m. on January 9 or as soon thereafter as the <br />matter can be considered. At that hearing you will have the opportunity to be represented and <br />heard. It will be reiterated that there is reason to believe that you are in violation of the <br />provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order and/or assess <br />a Civil Penalty in the amount of $ 100.00 to $1,000.00 for each day of violation.
