Kinder Morgan, Inc., previous owner of the gas pipeline, was recently sold to Tallgrass Energy <br />Partners. Attached is a letter from Tallgrass indicating that our project will have "no negative <br />impact" if certain parameters are met. The owners and operators of the converted Hansel Pit #1 <br />are hereby committing to the following: <br />• No mining will occur within 200 feet either side of said pipeline. <br />• A 10:1 slope will begin at 200' from said pipeline and descend away from the pipeline. <br />• No equipment other than passenger vehicles will cross the pipeline unless Tallgrass is <br />notified and a weight limit study can be conducted. <br />• CO811 will be notified and a locate requested when any excavation is performed closer <br />than 250' from said pipeline. <br />6.4.19 Exhibit S - Permanent Man-mad Structures <br />Where the mining operation will adversely affect the stability of any significant, valuable and permanent <br />man-made structure location within two hundred (200) feet of the affected land, the applicant may <br />either: <br />(a) Provide a notarized agreement between the applicant and the person(s) having an interest in the <br />structure, the applicant is to prove compensation for any damage to the structure; or <br />(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the <br />mining operation; or, <br />(c) Whereas such structure is a utility, the Applicant may supply a notarized letter, on a utility letterhead, <br />from the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no <br />negative effect" on the utility. Please provide the acquired agreement or an engineering evaluation that <br />shows the gas line in the proposed affected area will not be impacted by the proposed operation. <br />See the response above. <br />We would like to offer one additional question. Can the name of the pit be changed from Hansel Pit #1 <br />to Crystal Springs Ranch Pit in light of the change in ownership? <br />My contact information is given in the application.
