Mr. Andy Rodriguez, P.E Page 4 of 6 <br />Shores SWSP <br />November 26, 2012 <br />will have to obtain permission from the District 2 Water Commissioner to verify the Aurora <br />effluent can make it past any dry up locations between Metro Sewer and the Saint Vrain Creek. <br />Any Aurora effluent used to make replacements for the Shores pit will be assessed a transit Toss <br />based on 44 stream miles. Transit loss is therefore currently 22% (0.5% per mile) but is subject <br />to change by the water commissioner or Division Engineer. This additional water is only for <br />November 2012 through February 2013, and is the basis for the duration of this SWSP approval. <br />This SWSP will expire on February 28, 2013 unless this lease is extended to October 31, 2013, or <br />a lease sufficient to cover the projected depletions from March 1, 2013 through October 21, 2013 is <br />submitted to this office by February 1, 2013. Since the Aurora effluent is being used as a <br />replacement source for multiple plans, the applicant's accounting for each SWSP must specify the <br />total amount of effluent released on behalf of Bestway's lease, and the amount associated with <br />each SWSP. <br />A monthly breakdown of depletions and replacement is shown on the attached Table 7. <br />Conditions of Approval <br />approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2012 through February 28, <br />2013, unless otherwise revoked, modified, or superseded by decree. The plan may be <br />extended through October 31, 2013 if a copy of a sufficient lease is submitted to the <br />State Engineer's Office prior to February 1, 2013. If this plan will not be made absolute <br />by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee (currently $257) by January 15, 2013 or <br />August 15, 2013 if the SWSP approval period is extended. <br />2. Well permit no. 61716 -F was obtained for the current use and exposed pond surface <br />area of the gravel pit in accordance with §37 -90- 137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Shores Pit must not exceed 11 <br />acres during the approval period of this SWSP resulting in an annual evaporative loss of <br />29.45 acre -feet. <br />4. The annual amount of water used at the operation shall not exceed 1.66 acre -feet for dust <br />control, 14.86 acre -feet of water lost with the product (505,000 tons) and the amount used <br />for concrete batching shall not exceed 12.89 acre -feet used in the production of 105,000 <br />cubic yards of concrete. <br />5. Total consumption at the Shores Pit must not exceed the aforementioned amounts <br />unless an amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />7. All diversions including releases back to the river shall be measured in a manner <br />acceptable to the water commissioner or division engineer. The Applicant shall install <br />and maintain such measuring devices as required by the water commissioner or division <br />engineer for operation of this SWSP. <br />8. All releases of replacement water must be sufficient to cover all out of priority depletions <br />and be made under the direction and /or approval of the water commissioner. The <br />replacement may be aggregated to maximize beneficial use. The water commissioner <br />and /or division engineer shall determine the rate and timing of an aggregated release. <br />
