PI LON <br /> General Attorney <br /> Mined Land Reclamation Board November 18, 1977 <br /> Department of Natural Resources <br /> 615 Centennial Building <br /> 1313 Sherman Street <br /> Denver, Colorado 80203 <br /> Re: Application of Climax Molybdenum <br /> Company to Conduct Mining Operations <br /> Near Climax, Colorado. <br /> Gentlemen: <br /> By letter of October 19, 1977, the Railway Company was advised as <br /> to the above application by Climax Molybdenum Company, and further <br /> advised that any objections must be filed prior to November 24, <br /> 1977. <br /> This is to advise that the Railway Company owns right of way in <br /> Sections 11, 12, 13, and 14, Township 8 South, Range 79 West, <br /> 6th P.M. , as more fully shown on the print attached hereto. Said <br /> right of way is used by the Railway Company in its business as <br /> a rail carrier in interstate commerce, and is essential for <br /> conducting said business. It is respectfully submitted that any <br /> permit issued to Climax Molybdenum Company be made subject to the <br /> rights of way of the Railway Company, and further that any mining <br /> operations conducted adjacent or near said right of way be so <br /> conducted so as not to interfere with the operation and maintenance <br /> of the Railway Company. <br /> It is noted in the letter from Climax that the date, time, and <br /> place for Board consideration has not as yet been determined, <br /> but if there is a public hearing, the Railway Company wishes to <br /> be advised. <br /> Yours very truly 1 <br /> WLP:gk <br /> Encl. <br />
