The required public notice per Rule 4.17.2 was sent out by the <br />Division on October 22, 2012. However, since the site is considered a Designated Mining <br />Operation (DMO) a public notice is required per Rule 7.2.10. The Division does not have proof <br />of publication. Please submit the proof of notice as soon as possible so that staff may complete <br />the release process. <br />Per Rule 4.17.2 the Division has 60 days to conduct an inspection. A site inspection was <br />conducted by Division staff on October 30, 2012. The inspection (copy enclosed) notes the site <br />has only historic pre -law features that have never been disturbed under the permit. Additionally, <br />the features noted are covered under Permit M- 1977 -222UG and NOI P -2011 -033. This overlap <br />insures reclamation of the features if disturbed in the future. No human or environmental issues <br />appear imminent at these historic sites currently.
