During the first week of October 2012, the Einspahrs noticed water pooling in their
pasture. They have lived on this same property and used this pasture for many years.
Due east and adjacent to the pasture is a pit that has been filled with water. This reservoir
is in the south end of the graveling operation Brannon Pit #29 permit #M1981183.
On November 7, 2012 groundwater started seeping into the basement at 12735 Brighton
Road. This property is located west of the Einspahr property. Currently water is being
pumped out of the basement at an increasing rate and continuous pump use is necessary
for longer intervals. We are concerned about property damage, the loss of a business
investment as well as potential health issues to the resident of the house.
The Bromley property is surrounded by mining operations: the Stagecoach Pit MLRB
M1983 -067 due south and west; the Albert Frei & Sons operation (this maybe pit #4 M-
1977 -526) west and north and, the Brannon Sand & Gravel pit on the east.
Approximately 2 years ago Albert Frei & Sons started dewatering in the pit north of the
Bromley house (12801 Brighton Road). Shortly thereafter three of the Bromley's wells
went dry. Ben Frei agreed to and paid for city water to replace these wells. I believe it
was late 2011 that Albert Frei & Sons began dirt filling the pit on the north side of the
Bromley's property. Ben Fry inquires as to the status of the wells summer 2012 and we
determine that water had recharged the three wells. Albert Frei & Sons made their last
water payment for the Bromleys with the 9/28/2012 Brighton water billing.
If I can provide any more information please contact me, Winifred L. Bromley at 303-
659 -0038 or my brother, Kenneth M. Bromley at 303 - 659 -2168. Please send
correspondence to Winifred L. Bromley, 12801 Brighton Road, Brighton, Colorado
80601.
Sincerely,
Winifred L. Br mle & Kenneth M. Bro
1 ' 1 "
'w ro y
12801 Brighton Road
Brighton, Colorado 80601
Enclosures (2)
cc: Tom Kaldenbach, Senior EPS
Berhan Keffelew, EPS
Norman & Charlene Einspahr
