Nei] C ENERGY November 13, 2012 Mr. Jason Musick Colorado Division of Reclamation Mining & Safety (DRMS) 1313 Sherman Street, Room 215 Denver CO 80203 RE: Peabody Sage Creek Mine (Permit No. C- 2009 -087) Minor Revision (MR16 -12) Septic Area Small Area Exemption (SAE) Mr. Musick: Peabody Sage Creek Mining, LLC Peabody Sage Creek Mine PO Box 250 36600 Routt County Road 27 Hayden, CO. 81639 RECEIVED NOV 212012 Division of Reclamation, Mining & Safety Peabody Sage Creek Mining (PSCM) is submitting two (2) copies of the requested updates to the Mine Permit (C- 2009 -087) as MR -16 for the addition of a small area exemption (SAE) for the septic area near the shop and bath house facilities. The septic leach field is located just outside the facility perimeter ditch that reports to Pond 003. The area consists of 0.1 acres and while currently disturbed, has been seeded and will be completely revegetated. SedCAD analysis was done to determine the amount of sediment that could possibly leave the area. Because of the small size, a general model was run, and a report completed for a 1.0 acre vegetated area. It is the intent that the same model may be used for potential, future vegetated SAE's of 1.0 acres or less. The analysis was run for both the use of silt fences or check damns as control measures. According to SedCAD, silt fences would remove 96% of the sediment, and the check dam 45 %. It is the belief of PSCM that wattles would perform better than the check dams but not as well as the silt fence. Either wattles or silt fence will be used around the SAE for sediment control.
