Nei] <br />C ENERGY <br />November 13, 2012 <br />Mr. Jason Musick <br />Colorado Division of Reclamation Mining & Safety (DRMS) <br />1313 Sherman Street, Room 215 <br />Denver CO 80203 <br />RE: Peabody Sage Creek Mine (Permit No. C- 2009 -087) Minor Revision (MR16 -12) Septic <br />Area Small Area Exemption (SAE) <br />Mr. Musick: <br />Peabody Sage Creek Mining, LLC <br />Peabody Sage Creek Mine <br />PO Box 250 <br />36600 Routt County Road 27 <br />Hayden, CO. 81639 <br />RECEIVED <br />NOV 212012 <br />Division of Reclamation, <br />Mining & Safety <br />Peabody Sage Creek Mining (PSCM) is submitting two (2) copies of the requested updates to the <br />Mine Permit (C- 2009 -087) as MR -16 for the addition of a small area exemption (SAE) for the <br />septic area near the shop and bath house facilities. <br />The septic leach field is located just outside the facility perimeter ditch that reports to Pond 003. <br />The area consists of 0.1 acres and while currently disturbed, has been seeded and will be <br />completely revegetated. SedCAD analysis was done to determine the amount of sediment that <br />could possibly leave the area. Because of the small size, a general model was run, and a report <br />completed for a 1.0 acre vegetated area. It is the intent that the same model may be used for <br />potential, future vegetated SAE's of 1.0 acres or less. <br />The analysis was run for both the use of silt fences or check damns as control measures. <br />According to SedCAD, silt fences would remove 96% of the sediment, and the check dam 45 %. <br />It is the belief of PSCM that wattles would perform better than the check dams but not as well as <br />the silt fence.
