Pineda Director The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on November 20, 2012, an application to renew an existing permit to conduct coal mining operations at the Hayden Gulch Loadout was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. Hayden Gulch Terminal, LLC proposes to continue Loadout coal mining and/or reclamation operations on land located approximately 2 miles Southeast of Hayden, Colorado. The permit area is further described as follows: Portions of E1 /2 Sec. 10, W1 /2 Sec. 14, E1 /2E1/2 Sec. 15, NE1 /4 Sec. 22, NW1 /4NW1 /4 Sec. 23, Township 6 North, Range 88 West of the 6th P.M. These tracts of land are shown on USGS 7.5 minute Quadrangle map of Mount Harris. This is a permit renewal application for the next five year term. Because the above referenced permit renewal application might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered species, are requested. If wildlife habitat is the proposed postmining land use, we request your evaluation of proposed woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse impacts.
