Box 1169 Loretta Pineda <br />Pikeville, KY 41502 Director <br />RE: Open Exploration Projects <br />Dear: Mr. Glancy <br />The Colorado Division of Reclamation, Mining, and Safety (Division) is in the process of reviewing <br />outstanding Notices of Intents (NOI) on file that have expired, but may still have bond remaining. Central <br />Appalachia Mining has two of these NOIs. The Division would like to close these files and release the <br />associated bonds. <br />Regulatory requirements for final bond release include a submittal of drill hole abandonment reports for <br />holes drilled, a final reclamation report, a formal written request to the Division asking for bond release <br />and an on -site inspection of the complete holes. The status of the open NOIs are listed below with a <br />summary of each NOI based on the research of the files completed by the Division. <br />X- 2006 - 153 -14 <br />A $1,957.00 bond remains open on the project known as Geotechnical Drilling in Sections 8, 9, 10, and <br />16 of Township 8S Range 102W. According to our records, amendments to the drill hole abandonment <br />report and the final reclamation report were received April 19, 2007. These reports stated that two of the <br />drill holes were converted into monitoring wells (Hole No. V13-06 -3 and VB- 06 -10) with State Engineer's <br />Well Permit Numbers 270164 and 270165, respectively, and that CAM - Colorado is the user of these <br />wells. However, the Division's research indicates that these permits have expired. <br />We ask that you consider the following so that we can both remove this program from our files: <br />Please provide the Division with information and the status of these wells. <br />With regards to the two monitoring wells, the exploration bond may be released pending submittal of a <br />request for bond release and one of the following: <br />1. Transfer of wells as per Rule 4.05.14 to the landowner. <br />2. If these wells are a part of an approved monitoring plan and are currently bonded under another <br />bond instrument. <br />3. Submitting a Drill Hole Abandonment report and Final Reclamation Report after the wells are <br />sealed, plugged and reclaimed.
