Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has completed its adequacy review <br />of your application for the Technical Revision to the above referenced permit. The application <br />was received and called complete for review on November 2, 2012. The decision date for this <br />application is December 3, 2012. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br />The Division has identified several items that will require the submittal of additional information <br />or clarification of the existing information. <br />6.4.3 Exhibit C — Pre- mining and Mining Plan Map(s) of Affected Lands <br />1. The revised Mining Plan Map which was provided with this submittal shows there are <br />approximately 1.49 acres of land which have been affected outside of the permit boundary. <br />Based on the information provided to the Division, there is reason to believe that you are in <br />violation of C.R.S. 34- 32.5- 116(4)(i) for failure to protect areas outside of the affected land <br />from slides or damage occurring during the mining operation. The Operator has asserted that highwall slopes should not exceed 80 degrees from horizontal. <br />Please clarify is the Operator is committing to maintaining highwalls at an angle of 80 <br />degrees from horizontal or less.
