The purpose of the <br />MR is to provide for the Abatement of the cited NOV. While Oxbow believes the issuance of the <br />NOV is unwarranted and should be vacated, (see the November 8, 2012 Vacation Request to <br />Loretta Pineda, Division Director) we are, nevertheless, submitting new maps to clarify the as -built <br />configuration of the coal mine methane electric generating station relative to the adjacent Elk Creek <br />Mine. <br />Due to the exceptionally short timeframe for "Time For Abatement" of November 9, 2012, the three <br />copies of the maps will be hand carried to the Division separately by courier. <br />Please contact me at (970) 929 -5806 should you have questions or require further information. <br />Sincerely, <br />1 <br />James A.
