Kerr (Marr) Mine - Phase III Fanal Bond Release Request - Permit # C -80 -006 <br />and methodologies are outlined in the approved Minor Revision No. 37 (MR -37) submitted by <br />Kerr Coal Company. The project was completed October, 2002. The required Coal Exploration <br />Drill Hole or Well Abandonment Report was submitted to the Division dated January 26, 2003. <br />2.3 SEDIMENTATION PONDS, MINE SITE <br />The Sedimentation Ponds A, B, D, E and F are previously approved to remain as permanent <br />structures. Permanence of the ponds is in accordance with the postmining land use to water <br />livestock and wildlife. <br />Former Pond C that was adjacent to the shop facilities and former Pond G located north of <br />County Road 12 E were both reclaimed, reseeded and mulched during the summer season of <br />2006. <br />2.4 LOADOUT SITE POND (aka, Tipple Pond) 2011/2012 <br />The former sedimentation pond at the Kerr Loadout site (aka, Tipple Pond) and it's related <br />inflow ditch were drained and backfilled during November, 2011. Fill material used for backfill <br />was utilized from the berms and embankment that composed the pond. Prior to backfilling, the <br />topsoil on said berms was stripped and temporarily saved and then replaced on the backfill of <br />the pond footprint and inflow ditch. Given the weather conditions at that time, seeding was <br />postponed until April, 2012. The reclaimed area was then seeded with the approved seed <br />mixture, mulched with certified weed free hay and the mulch was crimped. During the growing <br />season of 2012, the DRMS inspections reported that the revegetated areas were becoming <br />well established. <br />3.0 PHASE III BOND RELEASE INFORMATION: <br />(1). Documentation that the ten -year minimum period of responsibility has been met for all <br />reclamation parcels included in the release application, including a map showing the dates of <br />the original and last seeding, etc. A narrative of the reclamation and management history: <br />The ten -year minimum period of responsibility has been met for all mining disturbance areas. <br />Permanent seeding of the remaining portions of the mine site area was completed in the 720 <br />Pit and Pit 1 during 1995 and 1996 respectively. The two remaining 4 acre parcels at the mine <br />site and the Loadout site were seeded in 1999/2000. <br />Dates of the original seeding and subsequent revegetation activities are shown on <br />accompanying Table 3, Reclamation and Management History Summary. A map showing the <br />revegetated areas, and the dates of seeding, is attached as the Phase 3 Bond Release Map. <br />Management of the site following permanent seeding included work to improve drainage and <br />sediment control structures, and enhance vegetation establishment. Contour furrows were <br />constructed on the numerous slopes in accordance with the approved plan and proved very <br />effective in erosion control.
