NOTIFICATION OF INTENT TO SEEK PARTIAL LIABILITY RELEASE
<br />PROPOSED PUBLIC NOTICE
<br />Twentymile Coal, LLC (TC) has filed an application with the Colorado Division of Reclamation, Mining, and Safety
<br />( CDRMS) for partial release (Phase 1 Bond Release) of reclamation liability for several areas of the Foidel Creek Mine
<br />(Mine). These facilities and areas, which include the CYCC Office Building, Eastern Mining District (EMD) /9 -Right
<br />Ventilation Shaft Installation, 18 -Right Intake Shaft Installation, and Fish Creek Tipple Facilities and an associated soil
<br />material stockpile located near the Middle Creek (Pit 3) Shop, are no longer needed to support ongoing or future operations,
<br />and have therefore been reclaimed. TC is the current owner, operator, and permittee under Permit No. C -82 -056 for the
<br />Mine and related support facilities. The Mine is located approximately twenty miles southwest of Steamboat Springs,
<br />Colorado near the intersection of Routt County Roads 27 and 33. TC's business address is:

<br />The partial liability release request covers areas within the Mine Permit Boundary that encompass the following specific
<br />areas; Township 5N, Range 87W, 6 Principal Meridian — Portions of Sections 2, 10, 11, 13, 14, and 29. These areas are
<br />shown on the Rattlesnake Butte and Milner 7.5 minute USGS Quadrangle Maps.
<br />The CYCC Office was constructed in 1967, and demolished in 2006. The EMD /9 -Right Ventilation Shaft Installation was
<br />permitted (TR95 -24) and constructed in 1996 to provide adequate mine ventilation airflow for ongoing operations m the
<br />Eastern and Northern Mining Districts. With completion of active mining in these areas, the associated facilities and area
<br />were reclaimed in 2009 -2010. The 18 -Right Intake Shaft Installation was permitted (TR04 -44) and constructed to provide
<br />adequate mine ventilation airflow for ongoing operations in the Northern Mining District. Subsequent additions included
<br />installation of an escape hoist in 2005 (MR05 -200), shaft heaters in 2007 (MR07 -225), and Mine Atmosphere Control
<br />Borehole in 2008 (MR08 -229). With completion of active mining in this area, the associated facilities and area were
<br />reclaimed in 2009 -2010.
<br />The Fish Creek Tipple Facihties were constructed in 1974 to receive, handle, and load coal to rail from the Energy Fuels
<br />No. 3 Mine and other Energy Fuels surface mining operations which were active at the time. The facility remained in use
<br />through about 1980. As applicable regulations were promulgated, this facility was re- permitted by Cyprus Yampa Valley
<br />Coal Company in 1984, in anticipation of possible use in conjunction with a nearby underground test mine. The Facility
<br />has remained idle since about 1980, and was reclaimed during the period 2011 -2012.
<br />The requested partial liability release addresses release of TC from any further liability for the facilities demolition and
<br />removal, shaft sealing, backfilling, grading, and drainage control activities that have been completed for the subject
<br />reclaimed areas. TC will retain liability for effective drainage control and revegetation of the subject areas, until such time
<br />as applicable revegetation success standards are achieved. Approval of the requested Phase 1 partial liability release will
<br />not affect the remaining reclamation bond, which will remain in -place to address any potential current and future remaining
<br />liabilities associated with all other active mine disturbance areas. Based on the DRMS's most recent bonding calculations,
<br />the bond surety that will remain in -place following approval of the partial liability release will be more than adequate to
<br />address the remaining liabilities.
